Rules Holiday Challenge Decathlon
Rules of the "Decathlon Holiday Challenge" contest organized by Group Pentathlon (GP)
1.CONTEST PERIOD
The Contest Period begins on December 21, 2022 at 8:00 a.m. and ends on January 11, 2023 at 11:59 p.m. (“Entry Deadline”). All times are Eastern Time.
2.HOW TO ENTER
By registering on the Sun Life Pentathlon des neiges website and making at least one post on the “Virtual Pentathlon des neiges” Facebook group
3.ELIGIBILITY
The Contest is open to all adult residents of Canada (18 years of age or older). Employees, officers and directors of the Group Pentathlon and its partners in this contest, as well as persons with whom they are domiciled, are not eligible to participate in the Contest.
4.DESCRIPTION OF PRIZES
(a) One Grand Prize: A set of equipment for cross-country skiing, cycling, skating, snowshoeing and running. Value of $2,399.
(b) One cross-country ski kit, value of $929
(c) One bicycle kit, value of $1,210
(d) One skating set, value of $350
(e) One snowshoeing set, $460 value
(f) One running kit, $400 value
(g) One sports discovery kit, including archery equipment, value of $575
(h) 6 (six) “Coup de coeur” prizes valued at $280 each
Total value of $8,003
5.DRAW
(a) For the prizes mentioned in 4.a, 4.b, 4.c, 4.d, 4.e, 4.f and 4.g, a random draw will be held on January 16 at 11:00 a.m. among all eligible persons (registered and having posted on the facebook group). For the prizes mentioned in 4.h, GP will determine at its sole discretion the “Coupe de Coeur” publications that will win these prizes.
(b) Participants who are selected as winners will be notified via email no later than five (5) days following the draw.
(c) To be declared a winner, entrants must respond within ten (10) days of the publication notifying them that they have won. Any selected entrant who does not respond within this ten (10) day period will be disqualified. No media is delegated to notify the winner.
(d) Prizes must be claimed within 3 months of the date of issue.
(e) Prizes must be picked up in person with identification at Decathlon Sainte-Foy.
(f) Winners will be responsible for any additional costs not specified herein as being included in the prizes.
(g) No financial compensation will be offered or payable if the actual value of the prize is less than the total value stated in these rules. Each prize must be accepted as awarded and is not transferable or exchangeable. Decathlon and GP reserve the right, in their absolute discretion, to substitute a prize with one of equal or greater value if the advertised prize is not available, in whole or in part, for any reason.
(h) Except as expressly stated herein, the Contest prize is provided “as is” without warranty of any kind.
(i) The decisions of the GP or its representatives are final and binding in all matters relating to the Contest and the awarding of a prize.
(j) To be declared a winner, selected entrants may be required to correctly answer, without assistance of any kind, mechanical or otherwise, a time-limited mathematical skill-testing question. They must comply fully with the Contest rules and regulations and, at the discretion of the GP, may be required to sign and return a liability release and publicity release form (“Release Form”) and such other documents as may be reasonably required by the GP, in its absolute discretion.
(k) Selected entrants may be required to provide proof of identity when claiming a prize or otherwise in connection with this Contest to facilitate accurate identification of winners.
(l) If a selected entrant does not meet the conditions set out in these rules or declines or forfeits a prize, the GP reserves the right, in its absolute discretion, to forfeit the prize, to select another entrant from among the remaining eligible entries in accordance with the process described above, or to donate the prize to a charity of its choice.
6.LIABILITY WAIVER / CONSENT TO PUBLICITY
By accepting a prize in the Contest, winners : demonstrate compliance with the Contest rules; acknowledge that the prize is not transferable (except as provided herein and only at the absolute discretion of the GP) and must be accepted as awarded, unless otherwise specified; consent to the use of their names, places of residence, voices, statements, photographs or other representations for publicity or informational purposes in any format by the GP or its advertising or promotional agencies in connection with this Contest or the prizes related thereto, without compensation or notice and releases the GP, its advertising or promotional agencies, and their respective directors, officers, employees and agents (collectively, the “Releasees”) from any and all liability in connection with the Contest or the awarding or use of any prize in connection with the Contest.
7.LIMITATION OF LIABILITY
The Releasees assume no liability and all entrants release the Releasees from any and all claims, actions, damages, demands or liabilities of any kind related to participation or attempted participation in this Contest and the prize, including without limitation, the administration of the Contest, the selection and confirmation of a winner, and the planning, awarding and use of any prize.
8.PRIVACY POLICY
By entering the Contest, each entrant consents to the collection, use and disclosure of his/her personal information for the purposes and in the manner described herein. Any information provided by entrants is collected by the GP and is subject to the PM’s privacy policy.
Online entrants may be offered the option of receiving commercial e-mail messages or other communications from the GP. However, eligibility to participate in the Contest is not contingent upon entrants consenting to receive such messages or communications, and consenting to receive such messages or communications will not affect entrants’ chances of winning the Contest. Entrants may unsubscribe from the communication mailing list at any time by following the unsubscribe instructions at the bottom of any communication sent.
9.GENERAL
(a) LAWS AND RULES. The Contest will be conducted in accordance with these rules, which may be amended without notice or liability to entrants by the GP. Entrants must comply with these rules and will be deemed to have received and understood them by participating in the Contest. The terms and conditions of this Contest, as set out in these rules, are not subject to change or counter-offer, except as set out herein. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
(b) CANCELLATION AND MODIFICATION. The GP reserves the right to cancel, modify or suspend the Contest or to amend the Contest rules at any time, in any way, without notice, for any reason. Without limiting the generality of the foregoing, if for any reason the Contest is not capable of running as planned, the GP reserves the right to terminate or suspend the Contest or conduct a random drawing from among all eligible entries previously received.
(c) CONDUCT. The GP reserves the right, in its absolute discretion, to disqualify without notice any entrant who it finds to be: in violation of the Contest rules; cheating or attempting to cheat in the entry process; tampering with the operation of the Contest or any website used in connection with the Contest; acting in an unsportsmanlike or disruptive manner with intent to annoy, abuse, threaten or harass any other person; or attempting to undermine the proper conduct of the Contest.
(d) ONLINE ENTRANT IDENTITY. If the identity of an online entrant is disputed, the authorized account holder associated with the email address provided at the time of entry will be deemed to be the entrant, provided the account holder’s name matches the name on the entry form. The person assigned to the e-mail address by an Internet Service Provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address will be deemed to be the authorized account holder. The selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All online entries must be submitted from a valid email account. If the authorized account holder’s name does not match the full name on the entry form, the GP may disqualify the entry from the Contest in its absolute discretion.
(e) QUEBEC RESIDENTS. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
(f) OTHER WAY TO ENTER. This Contest is also open to any person who wishes to participate (hereinafter referred to as the “Other Entrant”), subject to the conditions set out below. To enter, the Other Entrant must send a written request addressed to the GP, a minimum of one hundred (100) words in length, stating why he/she wishes to enter the Contest and describing what he/she would do with the prize, to 14 Soumande Street, Suite 1-6, Quebec City, G1L 0A4, on or after the Contest opening date. Any such written request must be received by the GP no later than two (2) business days (midnight) prior to the draw deadline. The aforementioned written request received within the above time period will be entered into the draw.
